TERMS OF USE & SERVICE

These Terms of Use and Service ("Terms") govern the purchase, download, and use of all digital products, including but not limited to 3D assets, textures, models, and avatars ("Products"), sold by KMRN ("Creator", "we", "us", or "our").

By purchasing, downloading, or using our Products, you agree to be bound by these Terms.

1. LICENSE GRANT

Upon purchase, you are granted a non-exclusive, non-transferable, non-sublicensable license to use the Products under the conditions outlined below.

You may:

• Use Products for personal use
• Use Products in VRChat and similar platforms
• Modify Products for personal use

You may NOT:

• Redistribute, resell, share, lease, or give away the Products in any form
• Upload Products publicly (including free uploads)
• Claim the Products as your own work
• Use the Products in a way that allows others to extract or access the original files

2. COMMERCIAL USE

Commercial use is permitted unless explicitly stated otherwise on the product listing.

If commercial use is allowed:

• Products must be part of a larger, transformative work
• You may not resell the Product as-is or in a way that competes with the original
• The original files must not be accessible, extractable, or reusable by others
• Credit may be required (see Section 6)

If a product is marked as non-commercial, you may not use it for any revenue-generating purposes.

3. AVATAR-SPECIFIC TERMS

Free and Nitro Assets Usage:

• Free and Nitro assets may be used on free, public, Nitro, and commercial avatars
• These assets must still not be redistributed, resold, or shared on a standalone basis
• The original files must remain protected and not easily extractable

For avatars purchased:

• Avatars are for personal use only unless stated otherwise
• You may upload avatars to your own account
• You may edit the avatar for personal customization

You may NOT:

• Share avatar files with others
• Upload avatars publicly or for others to clone
• Resell or distribute the avatar (edited or unedited)

4. REFUNDS & CHARGEBACKS

Due to the digital nature of our Products:

• All sales are final
• No refunds, exchanges, or cancellations will be issued

By purchasing, you agree not to initiate chargebacks. Unauthorized chargebacks may result in:

• Revocation of license
• Ban from future purchases
• Legal action if necessary

5. INTELLECTUAL PROPERTY

All Products remain the intellectual property of KMRN.

You are purchasing a license to use the Product—not ownership of the Product itself.

6. CREDIT

If credit is required, you must:

• Clearly credit KMRN
• Include a link to the original product or store page

Failure to provide credit (when required) may result in license termination.

7. NITRO EXCLUSIVITY PROTECTION

To protect paid and Nitro-exclusive content:

• Assets obtained through Nitro, paid access, or exclusive channels may NOT be redistributed in any form outside of the original purchase or access method
• Uploading Nitro or paid assets to free servers, public folders, or file-sharing platforms is strictly prohibited
• Leaking, ripping, or sharing these assets (whether modified or unmodified) is a violation of these Terms
• You may not include Nitro or paid assets in any free packages, bundles, or public avatars intended for mass distribution

Violation of this section will result in immediate license termination and may lead to bans from future purchases and further action if necessary

8. DMCA & ENFORCEMENT

KMRN actively enforces its intellectual property rights.

• Any unauthorized distribution, sharing, leaking, or resale of Products will result in immediate action
• We reserve the right to issue DMCA takedown notices to platforms including (but not limited to) Discord, Payhip, Gumroad, VRChat, hosting providers, and websites hosting infringing content
• We may pursue identification of users involved in infringement and take further action where necessary
• Access to KMRN Products and services may be permanently revoked without refund

By purchasing or using our Products, you acknowledge and agree that violation of these Terms may result in legal enforcement actions

9. LICENSE VERIFICATION & PROOF OF PURCHASE

To ensure proper use of KMRN Products:

• Users must retain valid proof of purchase (e.g., receipt, order ID, email confirmation)
• Proof of purchase must be provided upon request by KMRN
• Where applicable, license keys or identifiers may be used to verify ownership
• Failure to provide valid proof of purchase may result in:
• Revocation of license
• Removal of access to Products
• Restrictions on future purchases

Use of Products without valid proof of purchase will be treated as unauthorized use

10. PROHIBITED USES

You may not use our Products for:

• Illegal activities
• Hate speech, harassment, or discriminatory content
• NFTs, blockchain projects, or AI dataset training without permission

8. TERMINATION

We reserve the right to revoke your license if you violate these Terms.

Upon termination:

• You must delete all copies of the Products
• You lose all rights to use the Products

9. UPDATES & SUPPORT

• Updates are not guaranteed unless specified
• Support is provided at our discretion

10. LIABILITY

We are not liable for:

• Platform bans (e.g., VRChat)
• Misuse of Products
• Technical issues arising from modification or incompatibility

Products are provided "as is" without warranties of any kind.

11. CHANGES TO TERMS

We reserve the right to update these Terms at any time. Continued use of the Products constitutes acceptance of the updated Terms.
